10/26/2023 Court Fees for Service of Process

Effective 8/28/2023, Court Fees for Service of Process Section 57.280 & 488.435, RSMo, Senate Bill 186: Removes the requirement for any other person specially appointed to serve in a county that receives funds under Section 57.278, RSMo, to pay funds directly to the county treasurer. Now the court clerk shall collect ten dollars as a court cost for service of any summons, writ, subpoena, or other order of the court when any person other than a sheriff is specially appointed to serve in a county that receives funds from the deputy sheriff salary supplementation fund. The State Treasurer will then deposit the funds into the Deputy Sheriff Salary Supplementation Fund.

Due to recent legislative changes of Section 57.280 & 488.435 and the requirement for the clerk to collect the funds,

The Greene County 31st Judicial Circuit will implement the following procedure on November 20, 2023 for service filed this date and thereafter:

Upon initial case filing or subsequent requests for service throughout the case with a request for special process server, the $10.00 Sheriff Deputy Salary Supplementation Fee will be added as an outstanding fee. If not paid upon filing, the $10.00 fee will be placed on a payment plan with a due date of 30 days from the filing date. 60 days after that 30 day due date, the debt will then automatically be sent to debt collection under the filing party's name. At the time of the debt being turned over to debt collection, a 14.5% fee is added to the balance due.

Under 57.280, 4:

Any other person specially appointed to serve in a county shall execute and deliver to the circuit clerk, along with the confirmation of service, a signed and notarized affidavit of confirmation, made under penalty of perjury, that includes the amount, check number, and date of payment to evidence payment was made to the sheriff for the deputy sheriff salary supplementation fund as required by this subsection.

Upon the service return being filed or at any time, the filer could submit an Affidavit for Payment of Sheriff by Appointed Server with the above information listed. If this Affidavit is submitted, the $10.00 fee would be removed and no longer owed.

03-30-2021 CDC EXTENDS THE EVICTION MORATORIUM THROUGH JUNE 30, 2021

CDC Director Dr. Rochelle Walensky has signed an extension to the eviction moratorium further preventing the eviction of tenants who are unable to make rental payments. The moratorium that was scheduled to expire on March 31, 2021 is now extended through June 30, 2021.

The COVID-19 pandemic has presented a historic threat to the nation’s public health. Keeping people in their homes and out of crowded or congregate settings — like homeless shelters — by preventing evictions is a key step in helping to stop the spread of COVID-19.

ORDER CLARIFYING ALL PARENTING PLANS

IN THE CIRCUIT COURT OF GREENE COUNTY, STATE OF MISSOURI

Re: ORDER CLARIFYING ALL PARENTING PLANS

On March 13, 2020, national and state emergencies were declared following the classification of COVID-19 as a pandemic. In response, on March 16, 2020, the Missouri Supreme Court issued an Order suspending all in-person proceedings, with few exceptions, in the Circuit Courts of Missouri. In addition, all Missouri school districts have temporarily suspended classes. The temporary school closure is scheduled to expire, with students returning to a regular school schedule on April 6, 2020. However, the various school officials have publically announced that, depending on the developing circumstances, the school closure(s) may be extended.

The Court has become aware that based on the unprecedented circumstances caused by the pandemic, there has developed some confusion, and perhaps misinterpretation of previous orders issued by this court related to child custody, child visitation and parenting plans. This order is intended to clarify all custody and visitation schedules in Parenting Plans and previous Court Orders.

For purposes of determining the custody or visitation schedule, the original published school schedule shall control in all instances. Custody and visitation shall not be affected by the school’s closure that arises from an epidemic or pandemic, including what is currently referred to as the COVID-19 pandemic.

Nothing in this Order prevents parties from establishing their own agreement to alter the ordered schedule or from petitioning the court for a modification of prior orders.

This Order is entered and adopted this 19th day of March, 2020 by all Judges of the 31st Judicial Circuit.

FAMILY COURT UPDATE:

FAMILY COURT ORDER REGARDING CASE MANAGEMENT CONFERENCES

            Until further notice this Court’s Order for Case Management Conferences is suspended.  All Case Management Conferences in Family Courts 1, 2, 3 & 4 will be held by conference call as follows:

 

1.      Parties shall exchange the following documents and information seven days prior to hearing:

 

a.       Tax returns for the last three calendar years;

b.      Current income and expense statement;

c.       Most recent check stub with year-to-date information;

d.      Proposed Parenting Plan;

e.       Whether a party is requesting maintenance; and

f.       Verification of Parent Education class

 

Counsel shall file a Certificate of Service of required documents on opposing party.

 

2.      Parties shall exchange proposed Form 14 calculations no less than three days prior to hearing, with supporting documents and suggestions for numbers used in calculations.

 

3.      All counsel shall confer prior to the Case Management Conference in an effort to resolve issues regarding temporary contact and support.

 

4.      Case Management Conferences shall be conducted at their regularly scheduled time and shall be initiated by counsel for Petitioner unless otherwise agreed.  Clients need not be present.  Counsel shall have all counsel engaged in the call prior to contacting the Court. Contact the clerk for the Court in which you are scheduled promptly at the time of your setting.  Each attorney should announce the identity of those present with them during the call. 

 

5.      Counsel shall be prepared to respond to inquiries regarding completion of ADR and Parent Education classes, the need for a GAL and appropriate scheduling of mediation.

 

6.      Counsel shall have calendars available.  All necessary hearings and trial will be set during the call.

Temporary Change to Routine Motion Procedure

 

In response to public health directives related to COVID-19 and pursuant to the Order of the Missouri Supreme Court entered March 16, 2020, until further notice the Family Court Division of the Thirty-First Judicial Circuit has implemented the following procedure for the disposition of routine motions:

 

Routine motions are to be e-filed under the normal procedure.

 

If a routine motion may be sustained by agreement, a detailed written agreement shall be e-filed and the appropriate Family Court division clerk shall be notified via email that same has been filed.  A proposed order for the court’s consideration may be submitted to the Family Court division clerk via email and shall be in word format.

 

If a routine motion is contested, the attorneys shall advise the appropriate division clerk and shall submit available dates and times for a telephonic conference.  The court will schedule such a conference with notification made via docket entry.  Unless otherwise instructed, the attorney for the moving party shall be responsible for facilitating the conference call.

 

Requests for a hearing date/trial setting may be made by written correspondence to the division clerk.
